The Legal Advisor will provide comprehensive legal support to the Property Sales & Marketing Department, ensuring compliance with applicable laws and regulations while safeguarding the company’s interests. This role involves drafting, reviewing, and negotiating property-related agreements, advising on real estate transactions, and mitigating legal risks associated with property development, sales, and marketing activities.
Key Responsibilities
- Contract Management & Documentation
- Draft, review, and vet sale & purchase agreements (SPA), tenancy agreements, marketing collaboration agreements, and other property-related contracts.
- Ensure all sales and marketing documentation complies with the Housing Development (Control & Licensing) Act, Strata Titles Act, Contracts Act, and other applicable laws / regulations.
- Negotiate terms with purchasers, agents, vendors, and marketing partners to protect the company’s interests.
- Regulatory & Compliance Advisory
- Advise management and the sales team on regulatory requirements for advertising, promotions, and marketing campaigns under the Housing Development regulations and guidelines issued by relevant authorities.
- Liaise with government authorities, regulators, and external legal counsel on licensing, approvals, and statutory compliance.
- Monitor changes in property and consumer protection laws affecting sales and marketing activities.
- Risk Management & Dispute Resolution
- Identify potential legal risks in property transactions, sales practices, and marketing campaigns, and propose mitigating measures.
- Handle purchaser complaints, disputes, and pre-litigation matters related to property sales and after-sales services.
- Support dispute resolution processes, arbitration, or litigation in coordination with external lawyers when required.
- Strategic Support
- Provide legal input on new property launches, marketing initiatives, and business development projects.
- Assist in due diligence exercises for acquisitions, joint ventures, and collaborations with real estate agencies.
- Conduct legal training for sales and marketing staff on compliance and contractual matters.
Job Requirements
Qualifications & Requirements
Bachelor’s Degree in Law (LLB) from a recognized institution; admission to the Malaysian Bar preferred.Minimum 5 years of relevant legal experience, ideally with exposure to property development, sales & marketing, or real estate law.Strong knowledge of Malaysian property law, housing development regulations, contract law, and consumer protection laws.Excellent drafting, negotiation, and communication skills.High level of integrity, analytical ability, and attention to detail.Ability to work independently and provide timely legal solutions in a fast-paced environment.Skills
