Penerangan pekerjaanPreparing quality, timely and practical legal opinions and solutions on governance, regulatory, supervisory, contractual, enforcement and compliance issues relating to the following matters : currency management, operations, integrity and quality; financial markets and Islamic financial markets issues, and investment agreements (including Global Master Repurchase Agreement (GMRA) and International Swaps and Derivatives Association (ISDA) Master Agreements as well as Islamic documentation); exchange control law and international relations; management of subsidiary and affiliate entities; laws of general application e.g. constitutional law, administrative law, company law, commercial law, contract law, Islamic finance, criminal law, trust law, international law, procurement, taxation and consumer law; and other emerging issues (e.g. sustainability, digital assets, artificial intelligence). Preparing clear and precise draft primary and subsidiary legislation within the Bank’s legal mandates to accurately reflect the Bank’s policies and regulatory requirements; Meticulous drafting and vetting of contracts and other documents to protect the Bank’s legal interests with appropriate legal rights and remedies; Promoting legal awareness and compliance within the Bank; Liaising with, collaborating with and managing internal and external stakeholders such as ministries, Attorney General's Chambers, Treasury Solicitor's Office, Securities Commission Malaysia, Companies Commission of Malaysia, Malaysian Bar Council, Royal Malaysia Police, other Government agencies, external legal firms and the public; Bachelor of Laws with Honours (LL.B. (Hons)), Masters degree or PhD in legal field related to the role’s purpose and responsibilities is an added advantage. Minimum of 6 years working experience in rendering legal services as an in-house legal counsel in a statutory body, a corporate entity or the financial industry, or as a legal practitioner in the Judicial and Legal Service or private legal practice. Working experience with a financial regulatory authority is an added advantage. Intermediate to advanced level of knowledge on- powers, responsibilities, limitations and liabilities of a statutory body and regulatory authority; regulatory laws administered and financial industry regulated by the Bank; financial markets, financial agreements and Islamic finance; governance and corporate management; enforcement; and legal risk management; Intermediate to advanced level of skills on legal advisory, legal drafting, legal research, legal interpretation, leadership and people management, analytical thinking and problem-solving; and Basic to intermediate level of computer skills including Microsoft Outlook, Teams, Edge, Word and Power Point, and online legal databases. Analytical Thinking : The ability to critically analyse information and derive meaningful insights to inform decision-making and drive improvements. Communication Skills : Effective communication, both verbal and written, to convey ideas, insights, and recommendations clearly, concisely and persuasively. Adaptability and Flexibility : Being open to change, adjusting to new circumstances or requirements, and being able to pivot when needed to effectively respond to evolving organisational needs and priorities. People Advocacy : The ability to effectively represent and support the well‑being and interests of different stakeholders within the Bank. Relationship Building : Natural disposition to establish relationships with others to foster collaboration, trust, and effective teamwork. Regulatory diplomacy and negotiation – Managing relationships with relevant stakeholders such as fellow regulators and Government ministries Communication and storytelling – Writing in a style that balances precision with accessibility - Distilling highly technical legal advice into clear, persuasive narratives for line department and Management of the Bank Technological curiosity and digital fluency : Willingness to understand latest technology advancement, e.g. blockchain, AI, cybersecurity, and digital payments at a conceptual level; bridging the gap between legal frameworks and emerging technology Creativity in the application of established legal principles in solving new legal challenges arising from emerging areas / subject matters
Senior Legal Counsel, JUN Monetary Stability Unit, Legal
ROLE PURPOSE
Provide, and manage and guide a team of legal counsels, in providing the following in-house legal services to assist the Bank in discharging its mandates, managing its legal risks and protecting its interests :
- legal advice and solutions on law, governance, contract and legal risks;
- drafting / vetting primary and secondary legislation; and
- drafting / vetting contracts and other documents.
Bank Negara Malaysia (the Central Bank of Malaysia), is a statutory body which started operations on 26 January 1959. Bank Negara Malaysia is governed by the Central Bank of Malaysia Act 2009. The role of Bank Negara Malaysia is to promote monetary and financial stability. This is aimed at providing a conducive environment for the sustainable growth of the Malaysian economy.
PRINCIPAL ACCOUNTABILITIES
1. Assist the Bank in discharging its mandates, managing its legal risks and protecting its interests by providing the following services, and managing and guiding Legal Counsels and Associate Legal Counsels in providing the following services :
central banking (including monetary and financial stability, central bank governance and independence, reserve management and statistics);
2. Assist the DGC (and / or the department where necessary) in managing resources within the Unit and promote progressive enhancement to their technical and leadership competencies in meeting the department’s needs and mandates; and
3. Effectively participate in a meeting, committee, taskforce and project of the Bank or the Department to assist the Bank in managing its legal risks and protecting its interests.
